Well, yesterday I had the opportunity to work on five mediations for the Bergen County court.  The day began with both sides represented by counsel (the banks always have attorneys of course).  And the classic situation I've seen over the past three years presented itself.  Banks asks for info - defendant gives all the info - come to mediation - banks wants new info.

I beg defendant counsel to PLEASE be pro-active -- be "all over" the servicer - did you receive the information we sent?  Is it complete?  Do you need anything more? 

The banks are overwhelmed - BUT - I have witnessed where defendant's counsel follows-up with a bit of dogged determination modifications including HAMP modifications are being awarded.  

This year is very very different from previous years.  The banks are working with clients.

Also - some of the parties were pleased yesterday - some - both sides didn't like me - such is life as a mediator....
